Police change nature of offence to favour accused

jammu, May 12: Believe it or not, the police can go to any extent to help the influential. In a glaring example of misuse of official position, the Police changed the non-bailable offence to bailable offence just to ensure the accused persons (one of them reportedly is known to senior Police officer) who in an inebriated condition trespassed a house and assaulted a youth at Village Pasgal.


Moreover, out of three, two accused got bail in this assault case as concerned SHO (following dictates from seniors) registered case under section a bailable offence (451, 323, 34 RPC) to appease the senior police officer but the victim whose nose got fractured besides other multiple injuries still is crying for justice.

According to legal experts, section 452 states trespassing of house with an intention to hurt, assault or wrongful restraint. They however wondered though aforementioned case falls under this 452 Section but why concerned SHO and Investigation Officer (I/O) manipulated the case and have registered the same under 451 which is a balabale offence.

Not only legal experts but sources within police told Early Times that the case had to be registered under non-bailable offence (section 452) as three accused not only entered victim's house forcefully but also assaulted him. "The victim as per medical reports has got nose fractured (which comes under grievous injury) besides other injuries and all this is enough to book accused under a non-bailable offence, they said.

Meanwhile victim's family members too have alleged that police have weakened the case under deliberate attempt just to appease senior police officer and even are doing best to force victim's family to compromise with accused.

If recalled here, on April 30 night, three persons of the same village entered Raman Kumar' house and assaulted him with a rod as per the statement of family members.

Soon after the incident, the profusely bleeding victim alongwith family members rushed to the Police Station and narrated the matter to the Bishnah police which after assurance of action sent victim to Sub District Hospital (SDH) Bishanh for treatment surprisingly none of the cop accompanied the victim.
Police weaken case?
Police have weakened the case to appease a senior police officer and even are doing best to force victim's family to compromise with the accused.
The victim after preliminary treatment was referred ENT Department at SMGS Hospital Jammu for specialized treatment where victim was hospitalized for a week for his nose injury.

Family of victim further has alleged that the SHO delayed lodging of FIR after passage of more than 12 hours and after that the case has been registered under frail sections only to favour accused persons. SHO and IO are in all out effort to shield the accused by not arresting them for 10 days.

Despite pressure from SSP Jammu and SP Headquarter, the police least bothered to arrested accused as 10 days have been passed, two accused reportedly surrendered themselves and got bail within few hours.


"It seems the police are meant for accused persons not for victim," family alleged, adding that despite repeated pleas to concern SP as well as SSP Jammu, the SHO and IO are doing their duties at their own whims while without caring orders from their senior officers.

Doctors' "negligence" claims 2 lives
