Industrialist misusing brand name to sell product, police sleeping

JAMMU, June 23: An industrialist of the state is illegally making his business flourish even after the directions of the court which has directed the police to debar him to do so. But police is openly floating the directions despite pleas.

It is pertinent to mention here that Rakesh Kumar, son of Lt. Sh.Girdhari Lal M/S Jammu Oil Mills owing an oil brand naming Bangra brand complained about the use of the brand name by M/S J K Oil Mill by bringing minor changes in the trade mark.

He also later approached the court of 1st Additional District Judge Jammu for Permanent Prohibitory Injunction restraining M/S JK Oil Mill for using the Trade mark and Trade label.

After that Sharma also approached High Court with the similar appeal on which Justice Hasnain Masoodi had passed an interim order on 23rd May 2011 directing M/S JK Oil Mill to refrain from making use of the trademark registered with them till next date of hearing before the Bench.

But M/S JK Oil Mill didn’t comply with the order of the Court and continued the misuse of Sharma’s trade mark and trade label which amounts to contempt of court.

The written complainant has also been provided to Station House Officer (SHO) Bari Brahmana to enforce the directions of the Court by refraining M/S JK Oil Mill from misusing of trade mark and trade label of Jammu Oil Mills but till no action has been taken against the culprits.

A copy of the same application has been also forwarded to DIG Police Jammu-Kathua Range, Director CA&PD Jammu, Director, Drug & Food Controller, President, Chamber of Commerce & Industry (Jammu), Chairman, Bari Brahmana Industries Association (BBIA).

When contacted to SHO Bari Brahmana, Rakesh Akram admitted the written complaint and said that they cannot take any action against the alleged
brand owners till the court will not direct them to do so.

Doctors' "negligence" claims 2 lives
